Abstract

The role of a notary is closely related to the banking sector and ideally should always be present in every credit agreement to guarantee and provide certainty of such agreements. In distributing credit to gain profit, banks must ensure that the credit extended will be repaid and not become non-performing loans. However, in fact, in the field, nearly 70% of banking credit agreements, especially at Rural Banks (BPR), are made underhand without involving notaries. This leads to competitive banking business with great risk but also with commensurate profit in the banking sector. Therefore, in distributing credit, banks must have credit agreements with debtors as strong evidence held by the bank as authentic evidence. This thesis uses normative juridical research supported by data obtained through interviews with DPD PERBARINDO and BPR in Palembang City. The results of this study reveal that: First, credit agreements at BPRs in Palembang City without the involvement of notaries still have material evidentiary power. As long as these underhand credit agreements at BPRs are executed according to the BPR's Standard Operating Procedures (SOP), the credit agreements ive definite legal force and can be valid evidence in court; Second, notaries are not included in credit agreements at BPRs in Palembang City to reduce costs and maintain competitiveness in credit distribution. The urgency of notaries in credit agreements at BPRs in Palembang City in terms of jurisdiction is mandatory only for its use for credit agreements when the collateral involves land and/or buildings, or when securing large-scale loans.
