Abstract

Penelitian ini membahas penerapan pronsip insignifikansi dan irrelevansi pada studi pitisan nomor 10/Pid.sus-Anak/2016/PN Kgn, Putusan nomor 7/Pids-sus/2020/PN Tub, dan putusan nomor 2/Pid.sus-anak/2021/PN Rgt, yang menggunakan lembaga permaafan hakim pada Pasal 70 Undang-Undang Nomor 11 Tahun 2012 tentang sistem peradilan pidana anak (UU SPPA). penelitian ini juga membahas faktor-faktor yang mempengangaruhi penetapan pronsif yang signifikan
