Abstract

This research discusses the practice of diplomatic asylum granted by Mexico to Jorge Glas, former Vice President of Ecuador, and its implications for the diplomatic relations between the two countries from the perspective of international law. Mexico’s action sparked conflict after Ecuadorian authorities raided the Mexican Embassy in Quito to arrest Jorge Glas, who was accused of committing common crimes. This study applies a normative juridical method using statutory and case approaches. The findings indicate that diplomatic asylum is a practice not explicitly regulated under international law and is primarily recognized as a regional custom in Latin America. Granting asylum to individuals accused of common crimes is considered to be in conflict with various conventions such as the Caracas Convention and the Vienna Convention 1961. The case illustrates the urgent need for clearer international legal instruments governing diplomatic asylum to prevent sovereignty violations and maintain stable inter-state relations.
