Abstract

Majelis Arbiter dalam putusan BANI No. 646/I/ARB/BANI/2015 menyatakan bahwa hasil mediasi antara PT Pertamina EP dan Konsorsium IA tidak sah karena mediator tidak berwenang memutus sengketa. Padahal sebelumnya antara pihak PT Pertamina EP dan Konsorsium IA terdapat kesepakatan bahwa hasil mediasi akan menjadi penyelesaian akhir yang final dan mengikat. Tujuan penelitian ini adalah untuk menganalisis implementasi Pasal 70 Undang-Undang Nomor 30 Tahun 1999 sebagai alasan pengajuan pembatalan putusan BANI dalam putusan banding Mahkamah Agung Nomor 344B/Pdt.Sus-Arbt/2017, pertimbangan hukum hakim, dan akibat hukum yang timbul dari dibatalkannya putusan tersebut. Penelitian ini bersifat normatif dengan menggunakan pendekatan Perundang-Undangan, Pendekatan konseptual, dan pendekatan analitis. Hasil dari penelitian ini adalah putusan BANI diambil dari tipu muslihat yang dilakukan oleh salah satu pihak dengan menyembunyikan dokumen bersifat menentukan selama proses arbitrase berlangsung. Hal ini telah sesuai dengan huruf b dan c Pasal 70 Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penanganan Sengketa yang mengatur mengenai pembatalan putusan arbitrase oleh Pengadilan.
