Abstract

Skripsi ini berjudul Pertimbangan Hakim Dalam Menjatuhkan Pidana Penjara Terhadap Pelaku Tindak Pidana Pornografi Dengan Anak Sebagai Korban Konten Asusila Pada Putusan Nomor. 124/Pid.B/2022/Pn. Bit. Penelitian ini dilatar belakangi oleh maraknya kejahatan pornografi yang melibatkan anak sebagai korban, khususnya dalam bentuk penyebaran konten asusila melalui media sosial, yang mengakibatkan kerentanan besar terhadap keselamatan dan masa depan anak. Dalam perkara ini, terdakwa dijatuhi pidana penjara selama 1 tahun 6 bulan oleh hakim, perbuatan yang dilakukan tergolong serius dan memenuhi unsur dalam pasal 29 Jo Pasal 4 Ayat (1) Undang-Undang Nomor 44 tahun 2008 tentang Pornografi. Fokus utama penelitian ini adalah menganalisis Ratio Decidendi dalam menjatuhkan pidana, serta mengevaluasi bentuk pertanggungjawaban pidana yang dikenakan terhadap pelaku. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kasus serta mengacu pada peraturan perundang-undangan, doktrin hukum pidana, dan putusan pengadilan. Penelitian ini menemukan fakta bahwa hakim dalam putusannya lebih menekankan pada keadaan yang meringankan terdakwa, seperti sikap sopan terdakwa di persidangan dan belum pernah dihukum tanpa mempertimbangkan dampak psikologis dan sosial yang dialami korban anak.
