Abstract

The trade dispute between the United States and Canada concerning softwood lumber products represents one of the most complex cases in the history of dispute settlement under the World Trade Organization (WTO). This dispute originated from allegations by the United States that Canada engaged in dumping practices involving softwood lumber products, which were deemed harmful to the U.S. domestic industry. In response, Canada filed a complaint through the WTO dispute settlement mechanism, specifically through the Dispute Settlement Body (DSB). This research aims to analyze the process, mechanisms, and outcomes of the dispute resolution, as well as to evaluate the role of the DSB in ensuring compliance with multilateral trade rules. Using a qualitative-descriptive method, this study examines various official WTO documents, panel and Appellate Body reports, and supporting data from academic literature and policy reports. The findings indicate that the DSB plays a vital role as a neutral forum in resolving disputes and upholding the principles of international trade law. However, the implementation of DSB decisions faces several challenges, primarily due to the lack of political commitment from member states in fully executing the rulings. While the DSB mechanism provides a legalistic avenue for dispute resolution, its implementation is often hindered by protracted procedures, domestic political interests, and limitations in enforcement authority. Although the DSB serves an essential role in mediating disputes, the resolutions achieved are often temporary and require bilateral agreements to be truly effective and sustainable. This case illustrates the need to strengthen the WTO dispute settlement system to make it more effective and responsive to the evolving dynamics of global trade relations. This research is expected to contribute to the development of international legal studies, particularly in the field of trade dispute resolution and WTO institutional reform.
