Abstract

In the case of submission notification of Investigation commencement which is not continued by submission of the case file to achieve certainty, justice and utilization. The type of research used are normative and sociological legal research. The types and sources of research were obtained from primair and secondary data, collected through literature and observation, analyzed used qualitative, in conclusion used inductive logical thinking. This results of this study are: the action of investigator who did not submit the results of investigation in the form of case file without a legal basis to the public prosecutor, have fulfill qualification obstructing the process of law enforcement. (obstruction of justice) as stipulated in article 221 of the criminal code that is giving help people to avoid investigation or detention by judicial or police official, or by another person according to the provision of law continuously or temporarily handed over to run the police position. The action of investigator who did not submit the results of the investigation in the form of a case file without a legal basis to the public prosecutor beside that contrary the value of expediency, the value of justice, and the value of legal certainty and also there were criminal sanctions. In the development and situation in Indonesia, ideally the regulation obstruction of justice must be defined definetly, specifically, and completely in Indonesia legislation that aims to form a common understanding among law enforcer. The actions of obstruction of justice can be avoided by the way of investigator notifying the public prosecutor the reason according to a legal basis why did not sending a case file, so that the investigator is given the time in conducting an investigation and sending a case file to the prosecutor to create certainty, fairness and legal benefit and adjustment about obstruction of justice in the future are contained in an article in the criminal code/special chapters in the criminal code/special law outside the criminal code to provide definitive, specific, and complete about what actions are qualified as acts of obstruction of justice and include criminal threat for every person who commits an act of obstruction of justice starting from investigation, initial investigation, prosecution, the court and the execution stages.
