Abstract

Compliance of correctional rights of children in every LPKA (Lembaga Pembinaan Khusus Anak) should be given without exception; however, not all LPKAs are able to implement these rights in accordance with the existing regulations. In this thesis, there are significant differences related to the compliance of the rights of correctional students in the LPKA and this is not in accordance with the provinsions of the legislation of Article 85 paragraph (1) No. 11 of 2012. Then the issues to be discussed are given in the questions as follows: What are the rights guaranteed by law related to the correctional students in LPKA, How is the implementation of the compliance of the rights of correctional students in LPKA of class I Pakjo Kota Aplembang City and in LPKA of class II Wonosari Gnungkidul, How should the concept of improvement related to the compliance of the rights of correctional students be in the future. The research method used was normative research. `The results of the study showed that 1) The rights guaranteed by law related to the compliance of correctional students are based on the Presidential Decree No. 6 of 1990 concerning the Ratificatiob of the Convention on the Rights of the child, namely the right to get a sustainable life, the right to get protection, the right to grow and develop, and the right to participate; 2) Implementation of fulfilling the rights of children in conflict with the law had significant differences, having not yet well implemented, and having a lot of discrimination occurring to the children. The implementation of the Convention on the Rights of the Child has not been effective; 3) The concept of improvement that can be offered to improve the compliance of the rights of correctional students in LPKA in the future are as follows: the Law on the Criminal Justice System for Children is amended, changed and/or revised again.Furtermore, the contents of the Law are still very general in explaining some things related to several provisions, only giving the points without any emphasis on obligation, mandatory, and there is no comprehensive explanation of an accepted sanction rule if all LPKAs do not implement the rule. It is suggested that in realizing the equality of handling the children detained in the LPKA, it require coordination between the law enforcement officials, relevant agencies, and elements of society to realize a systematic, comprehensive, sustainable, and integrated handling.
