Abstract
Jus cogens is a norm thought to be so fundamental that it even invalidates rules drawn from treaty or custom. This definition can represent so many definition on jus cogens. One of the most popular crime in jus cogens is aggression. Aggression is an axtra ordinary crime that is ruled by Rome Statute 1998. But, the problem is that there is not definition about the subjectpricesely. In the international law structure jus cogens is well-known as the highest source of law. But the norm is still abstract in meanging. We cannot find the conditions an act is called aggression on jus cogens, while aggression is still going around the world As long as standingpossition of ICC, there is no cases related to aggression that can be resolved. This is because that there is no precise definition about aggression and the subject of aggression commonly state that has powerfull influence in theworld, minimally at Security Councilin the United Nations.
