Abstract

Children are the next generation of the nation who are very vulnerable to becoming victims of transnational criminal acts such as criminal acts such as criminal acts of trafficking in persons. To overcome this nationally and globally, the Indonesian Govermment ratified the ASEAN Convention against Trafficking in Persons (ACTIP) espesially women and children in 2017. This is normative study using secondary data. The Data were gathered by menas of literaturereview analyzed qualitatively and concluded deductively. The results of the study show that ACTIP’s ratification of crime of child trafficking in Indonesia is urgent because trafficking in persons, espacially children as victims, is the highest crime in the word; the area and the location of Indonesia as an easy acces to child trafficking, Indonesia as the sending country, source country, and destination country for the largest migrant workers in Asia: and children to infants as victims of human trafficking. The legal implications of the implementation of ACTIP on the prevention of criminal acts of child trafficking in Indonesia are by completing the exiting and applicable laws and regulations in Indonesia, especially Law Number 21 of 2007 concerning Eradication of Criminal Acts of Trafficking in persons with policies that have not been regulated and specified, firstly, a repressive policy that regulates: more severe criminal threats if the child victim is infected with HIV / AIDS and if the perpetrator is more than one person; criminalization of money laundering; and criminalization of involvement of state administrators for corruption. Secondly, preventive policies that regulate the obligation of countries to adopt or strengthen legislation or other actions through bilateral and multilateral coorperation in the education, social and cultural fields.
