Abstract

This study examines the making of authentic deeds before a Notary with the concept of Cyber Notary which associated with article 1868 of civil code. The making of authentic deeds is included in the authority of the Notary in carry out its authority and obligations as a Notary. Provisions regarding the making of authentic deeds that must be attended by viewers and participants witness attending before a Notary. Authentic deeds explain that "A deed made in a form determined by law, made by or in front of the general employees who are in charge for that in a place where it made ". Unlike the case of Cyber Notary concept where the making of authentic deeds is not required to be faced between viewers, witnesses and Notaries but can use electronic devices such as teleconferences or video calls so that the distance between the parties is not a big problem. The purpose of this study is to examine and analyze the application of law towards making authentic deeds using Cyber Notary. Other than that to find out what deeds can be made with the concept of Cyber Notary. This legal research is a normative research using legislation approach and conceptual approach. The results of this study show that the application of Cyber Notary to the making of authentic deeds is completely inoperable, except for the viewers that can be presented via video conference (article 77 paragraph 1 of the company law), and every authentic deed can’t be made with the concept of Cyber Notary except for the making of a formal deed such as the minutes of the General Meetings Minutes and Minutes of Meetings, as such it was concluded that article 1868 of civil code could be ruled out for the existence of article 77 paragraph 1 of company law.
