Abstract

This research examines the dynamics of the freedom limits to make marriage agreements in the principle of freedom contracts, namely the marriage agreement contents must not reduce rights and obligations between husband and wife so that in the future it does not cause conflict in order to create fairness in marital ties. The problems examined are how to limit the freedom to make marriage agreements, notary authority and notary legal responsibility in making marriage agreements. The research results is indicate that the freedom limits of agreement according to article 29 paragraph (2) marriage Invitations may not conflict with law, religion, and morality. The authority of a notary to make a marriage agreement is regulated in Article 15 paragraph (1) of the Act of Notary Position, namely a Notary has thee authority to make authentic deeds regarding all acts, agreements and provisions required by legislation an/or desired by those concerned. The notary’s legal responsibility in making a marriage agreement is to ensure the making of a marriage agreement in the form of a perfect deed which is recognized as validity which in the form of the notary responsibility seeks to carry out the duties of notary and does not conflict with legislation
