Abstract

This thesis research is entitled "The Use of Assembled Firearms and Explosives" which is against the background of the development of crime in Indonesia which is getting higher and even the perpetrators of crimes are no longer using conventional methods of action. to expedite the action of the perpetrators of crime in general using tools such as firearms. Based on the background mentioned above raises the following problems: 1. What is the process of ownership of firearms and explosives by civilians? 2. What is the urgency of civilian possession and use of firearms and explosives? Who has the authority to issue a permit policy for the use of firearms and explosives for military and civilian interests? To answer this problem, normative legal research methods are used, using the theory of the rule of law as the Grand Theory, the theory of authority as the middle theory, and the principles and arrangements regarding the ownership of firearms and explosives as applied theory. Based on these results it can be concluded that the process of ownership of firearms and explosives is set in the National Police Chief No. Pol. : Skep / 82 / II / 2004 February 16, 2004. Urgency of ownership and use of firearms and explosives by civilians, for civilians in order to maintain the territorial integrity of the unitary state of the Republic of Indonesia and maintain security and order in society, while firearms for civilian interests limited to being used for individual interests in the form of self-defense and hobbies as well as for sporting purposes. Authorized to issue a permit policy for the use of firearms and explosives for military and civilian interests is the Head of the National Police or the National Police and cannot be delegated to the Head of the Regional Police or the Regional Police Chief.
