Abstract

The implementation of the obligation of the public prosecutor to carry out an investigation in the context of accelerating the settlement of criminal cases of forest destruction (case studies / cases of forest destruction in the high prosecutors of South Sumatra) is focused on giving authority to the public prosecutor to carry out investigations as well as factors that cause investigations by investigators contained in the dossier the examination was deemed incomplete by the public prosecutor. This research is a normative research. The research material was obtained from primary legal materials, secondary legal materials and tertiary legal materials. Collected through library research supported by interviews Using a qualitative descriptive research approach with deductive deduction techniques. The results of this study are the completeness of forest destruction case file requirements which must be completed by investigators based on Law Number 18 Year 2013 concerning Prevention and Eradication of Forest Destruction basically still referring to the Criminal Procedure Code, and / or other evidence in the form of electronic information, electronic documents, and / or map. the factors that caused PPNS to not be able to fulfill the completeness of the files based on the Case Study / Case on Forest Destruction in the South Sumatra High Prosecutor's Office are: 1. Regulatory Factors, 2. Internal Factors, 3. Facilities Factors. The actions of the Public Prosecutor to be able to resolve the case of forest destruction, namely: Coordination between the public prosecutor and the investigator since the beginning of the SPDP issuance; undertake a multi-legal approach that relies on various relevant laws and regulations. In the implementation of the acceleration of the settlement of forest destruction criminal cases in the future there should be clear, definitive, specific and complete rules regarding the position of investigators in the crime of forest destruction and there must be a clear SOP in taking over the authority of investigators by the Public Prosecutor.
