Abstract

Practically, there are often two or more court decisions in different domains whose substance contains contradictions, such as Decision No. 2023K/Pdt/2007 and Decision No. 202K/Pid/2012. The object of the case in the two decisions is the same, namely regarding the deed of sale and purchase of land, but the rules are different. The problems in this thesis are: 1) What are the legal considerations in Decision No. 2023K/Pdt/2007 and Decision No. 202K/Pid/2012?; 2) How is the legal strength of a court decision contradicting other court decisions on the same object of dispute ?; 3) Can court decisions with different domains be / are not used as legal considerations on other court decisions whose object is the same case?. From the results of research and discussion it can be concluded that decision No. 2023K/Pdt/2007 is based on the consideration that buying and selling happens to be valid, even though the formally does not comply with the provisions of the law, such as no PPAT stamp, and so forth. Then decision No. 202K/Pid/2012 is based on the consideration that the defendant and witness Sunarti had intended to use a legal deed of sale and purchase to file a lawsuit with the Sangeti District Court because there was no PPAT stamp, no signatures of the parties, no signatures of witnesses , there is no register number, and does not use paper size A.3. Court decisions that have obtained legal force still have the strength of evidence, so that it can be used as evidence by parties who litigate as far as the events specified in the decision. Court decisions can be used as legal considerations for other court decisions provided that they have the same object matter.
