Abstract

There is a equal or double authority between Article 66 of UUJN and Article 23 Paragraph (2) point (e) and (f) of Regulation of the Minister of Law and Human Rights Number 40 of 2015, which is the authority for granting approval of summoning a Notary at the request of Investigators, Public Prosecutors, and Judges for judicial proceedings. In this research the problems discussed are (1) who is authorized in giving approval to call a Notary for the Judicial proceeding? (2) What legal protection efforts are given to Notaries who are called to the Judicial proceeding? Based on the hierarchy of laws and regulations which UUJN is higher than the Regulation of the Minister of Law and Human Rights, thus the Honorary Board of Notaries has the authority to give approval to call Notaries by Investigators, Public Prosecutors, and Judges in the judicial proceeding. The form of legal protection by the Honorary Board of Notaries is preventively intended to avoid the occurrence of disputes. The suggestion from this study is that the Minister of Law and Human Rights when making legislation be able to regard other legislation in order to avoid double/equal authority.
