Abstract

Disparitas pidana adalah penerapan pidana yang tidak sama terhadap tindak pidana yang sama yang sifatnya berbahaya dapat diperbandingkan tanpa adanya pembenaran yang jelas. Disparitas pidana dapat menimbulkan rasa ketidakadilan bagi terpidana. Permasalahan pada penelitian ini adalah bagaimana penerapan sanksi terhadap pelaku tindak pidana menghilangkan nyawa orang lain pada Putusan Nomor 151/Pid.Sus/2013/N.Jkt.Tim, Putusan Nomor 433/Pid.B/2013/PN.Pdg, dan Putusan Nomor 141/Pid.Sus/2015/PT.Mdn dan mengapa terjadi disparitas dalam penerapan sanksi pidana tersebut. Penelitian ini menggunaan metode penelitian Normatif, yang dilakukan dengan cara meneliti menggunakan data sekunder seperti buku-buku, peraturan perundang-undangan, dan teori-teori hukum. Hasil Penelitian dari penulisan ini adalah alasan terjadinya disparitas pidana pada tindak pidana menghilangkan nyawa orang lain karena kelalaian berkendaraan bersumber dari hukum itu sendiri dan persepsi hakim. Diperlukan pedoman bagi hakim untuk menentukan jenis pemidanaan yang tepat untuk mendapatkan keputusan yang seadil-adilnya. Kata Kunci : Disparitas, Menghilangkan Nyawa Orang Lain Karena Kelalaian Berkendaraan
