Abstract

Skripsi ini berjudul “PERTANGGUNGJAWABAN PIDANA TERHADAP PELAKU PENYEBAR PORNOGRAFI BALAS DENDAM (REVENGE PORN) DI MEDIA SOSIAL (STUDI PUTUSAN HUKUM)”. Permasalahan dalam tulisan ini adalah 1) Bagaimana pertanggungjawaban pidana pelaku penyebar pornografi balas dendam (Revenge Porn) di media sosial menurut studi putusan hakim; 2) Dasar pertimbangan hakim dalam memutus perkara pidana terhada pelaku penyebar pornografi balas dendam (Revenge Porn) di media sosial sosial menurut studi putusan hakim. Penelitian ini bersifat normatif yuridis dengan pertimbangan bahwa titik tolak penelitian berdasarkan Putusan Nomor 78/Pid.B/2015/PN-Prob, Putusan Nomor 267/Pid.Sus/2015/PN-Cms, dan Putusan Nomor 2143 K/Pid.Sus/2015 yang didapatkan dari Direktori Putusan Mahkamah Agung. Skripsi ini menggunakan pendekatan undang-undang dan studi putusan hakim. Pertanggungjawaban pidana di tingkat pengadilan terhadap pelaku penyebar pornografi balas dendam atau revenge porn di media sosial bila ditinjau dari teori pertanggungjawaban pidana, teori pemidanaan dan teori putusan hakim dan faktor-faktor yang mempengaruhi pertanggungjawaban pidana dan dasar pertimbangan hakim dalam memutus perkara itu sendiri.
