Abstract

The land is a necessity of human life that is very fundamental.Human life as well as activities above the ground so that every time a human is always associated with the land can be said of almost all activities of human life either directly or indirectly always require soil. At the moment the human died, the world still require land for burial So the importance of soil for human life.State land together with for example the land belongs to and other rights, describe a the status of certain legal relations between the object and the subject. But expanded to include also the right over the body of the earth below and the air space above it, within reasonable limits. The land given to and possessed by the person or legal entity with the rights provided by the BAL is used or utilized.He gave and he owned the land with those rights will not be meaningful if its use there is only on the ground as the surface of the earth. Judicially, the land can be granted rights to the community to utilize the land. Property rights is one of the rights of atash such land.Due to property rights to land has economic value that can be charged on the encumbrance as collateral for the debt covenant accounts receivable. However when the freehold is in the installation of encumbrance occurrence of land procurement on the object of encumbrance, which resulted in the bank as a creditor feel aggrieved against the condition, due to property rights to land clear as it falls to the state.The procurement of land to make the debtor as the owner of land rights to obtain redress. So the author conducted the research to the creditor as the holder of the guarantee obtain redress of property rights on the land. Research methods used are empirical methods, using empirical data as a reference in writing research. The empirical Data obtained through interviews with the land office, the bank and the notary.
