Abstract

Notary is one of the authorized officers with the right to use the seal of the state symbol because the notary is considered having the important role in making the authentic deed. The notary in implementing the work must follow the prevailed rules and also be accurate so that the deed will not causing problem later on. The formulation of problem in this research is related to the form of deviation from the use of the seal of the state symbol in the notary practice, and how the legal responsibility of the Notary who neglects the use of the seal of the state symbol. This is a normative research, using legal approach and conceptual approach, analyzed qualitatively, with deductive deduction technique. The results of the problem indicates that the use of the seal of the state symbol in the notoriety scope still has a lot of misuse of usage. The legal consequences of Notary who misuse the seal of the state symbol can be given civil sanctions and administrative sanctions contained in UUJN and also sanctions outside the UUJN namely, Article 69 of Law Number 24 of 2009 concerning Flags, Languages, and State Symbol, and National Anthem which is punished by imprisonment for a maximum of 1 (one) year or a maximum fine of Rp.100,000,000 (one hundred million rupiahs) and in article 15 paragraph (1) of Government Regulation Number 43 of 1958 concerning the Use of the State Symbol which is confinement for as much three months or a fine of up to five hundred rupiahs.
