Abstract

Notary position and profession are position and profession of trust that must be respected and honored, so that in carrying out their work in making authentic act they have legal certainty value. Therefore, the Act of Notary Position Number 2 of 2014 gives a disclaim obligation to the notary, namely the obligation to maintain the confidentiality of the contents of the act he made. Morover, the protection provided by the Honorary Board of Notary (MKN) is also given to the notary. MKN has the function of providing guidance to a notary in the form of approving or rejecting request for approval submitted by investigators, public prosecutors, or judges in the face of judicial proceedings, to request minuta act or notary protocol.The problems are (a) how the function of the MKN guidance is carried out, and (b) how the mechanism of the disclaim obligation (verschonningsplicht) of the notary is protected by MKN.By conducting normative legal research, this study finds that : (a) the formulation of law and regulation does not clearly and explicitly regulate the function of MKN guidance in the context of facing the judicial process. The relevant law and regulation actually formulate the referred guidance as an examination of the notary, and the "guidance" referred to, is only carried out when there is a request from the investigator, public prosecutor or judge in the criminal justice process. The law and regulation does not regulate how if the process faced is a civil court process or other judicial process, (b) the mechanism carried out by MKN in carrying out the said "guidance" is carried out after a written request from the said law enforcement apparatus forms the Examination Board, summoning and examine the notary, and giving a decision or rejection of the request submitted within a maximum period of 30 (thirty) working days from the receipt of the written application letter from the criminal justice law enforcement party.Based on these findings, this study suggests a revision to law and regulation related to the function of MKN guidance and mechanisms for granting approval to law enforcement officers in the scope of criminal, civil, state administration, or other judicial environments.
