Abstract

This thesis is entitled "The Legal Consequences of Construction Work Agreement which does not cover the Employment Social Security Clause (Study of Several Construction Work Contracts in Local Government of Sungai Penuh City, Jambi Province)". With 4 (four) problems, namely: (1) Does the Construction Work Agreement in the City Government of Sungai Penuh City, Jambi Province in 2018 have included an Employment Social Security Clause, (2) The Legal Consequences for the Construction Work Agreement which did not include an Employment Social Security Clause, (3) ) The impact of legal protection on workers in the Implementation of the Construction Work Agreement and (4) the Construction Work Agreement which should be developed and implemented. This research is a normative legal research, which is a scientific research procedure to find the truth based on scientific logic from the normative perspective. 75 Construction Work Agreements at Sungai Penuh City Government during 2018, all of the package of activities does not include an employment social security clause. The Construction Work Agreement which does not cover a worker protection clause, contains provisions on the obligations of the parties in the implementation of occupational safety and health as well as social security resulting in the Construction Work Agreement being null and void by law. Construction Service Employers do not carry out their obligations to register their workers in the accident insurance (JKK) and death protection (JKM) Programs under Social Security Administrative Bodies (BPJS), resulting in workers not being covered by the Work Accident Security Program (JKK), Death Security Program (JKM) and not getting additional facilities. The main clauses in the framework of the Sungai Penuh City Government Construction Work Agreement must comply with Article 47 paragraph (1) of Law Number 2 of 2017 concerning Construction Services.
