Abstract

After the Constitutional Court Decision Number 18/PUU-XVII/2019 (MK Decision Number 18), the creditor may not carry out his own fiduciary collateral object but must submit a request for execution to the court until the decision of a permanent legal force is issued, with the condition that there is no agreement to determine the injury debtor promises and debtor in volunteer handing over fiduciary collateral objects. This research is a normative legal research, with the source of legal material obtained through secondary data and collected through literature study. The results of this study are, the impact of the fiduciary guarantee object execution after the MK Decision Number 18legally is, the extension of the executorial tittle norm equivalent to a court decision that has permanent legal force; legal vacuum completeness of the conditions for a court's execution decision in the document for an auction execution; legal vacuum in auction execution category; fiduciary guarantee loses it’s specificity regarding the ease of execution; and the ambiguity of the meaning of the inclusion of agreement clauses concerning the promulgation of promises and volunteerism of debtors to submit fiduciary collateral objects. The non-juridical impact is, the execution process through the court which takes time and costs that has the potential to cause bad faith in the debtor or prospective debtor; increasing requests for execution through the courts; difficulty in obtaining credit if the object of collateral is relatively low; stigma of finance companies can no longer execute without a court decision; and disruption of the financial health of finance companies. The proportional principle-based legal protection policy for future fiduciary debtor and creditor, a thorough and detailed reading of the terms of the agreement on the breach of contract and volunteerism of the debtor to submit the object of fiduciary security before signing by the parties; using Advocate's legal services to prioritize non-litigation efforts; creditor’s and debtor’s agreement to prioritize execution alternatives through underhand sales; and issuance of implementing regulations or technical guidelines for execution through the courts.
