Abstract

The world nickel demand getting increased day by day, one of the reasons is due to the increasing use of electric vehicles. Therefore, the Government of Indonesia takes an action to safeguard the domestic of nickel needs and enhancement the value-added of its coal mineral by issuing a set of regulations that limit the nickel exports and additional regulation such as the purification obligation and the obligation to build purifying facility before its get exported. But the policy is considered detrimental to the European Union. So on this basis, the European Union filed a lawsuit against Indonesia in the World Trade Organization, until now the European Union has submitted a consultation with Indonesia. The purpose of this thesis is to find out the regulation of international trade, specifically regarding quantitative restrictions and to understand the rules on nickel export restrictions on the international scope. This research was conducted using a descriptive, juridical, and analytical approach with the juridical normative method. The result of the research is consultation as an effective effort that can be taken by the Government of Indonesia in this dispute. The conclusion that can be drawn is that restriction can be taken if there are conditions which occur as stated in General Exceptions and National Exceptions GATT.
