Abstract

ABSTRAK Ditegaskan dalam Pasal 28 ayat (3) dan Pasal 34 ayat (2) UUD 1945 “Jaminan sosial merupakan hak setiap warga negara” dan “Negara mengembangkan Sistem Jaminan Sosial bagi seluruh rakyat dan memberdayakan masyarakat yang lemah dan kurang mampu”. Untuk itu pemerintah menyelenggarakan program jaminan sosial terutama untuk tujuan terjaminnya hak kesehatan orang miskin atau kurang mampu. Maka dari itu penulis melakukan penelitian dengan judul” Perjanjian Kerjasama antara Badan Penyelenggara Jaminan Kesehatan dengan RSUP Dr.Mohammad Hoesin dalam Pelaksanaan Pelayanan Kesehatan” Penelitian yang bersifat normatif ini mengkaji tentang; 1. Bagaimana hubungan kerjasama antara Badan Penyelenggaran Jaminan Sosial Kesehatan dengan RSUP Dr.Moh. Hoesin?, 2. Bagaimana pelaksanaan jaminan layanan kesehatan oleh RSUP Dr.Moh.Hoesin bagi peserta program jaminan kesehatan nasional?, 3. Bagaimana upaya pihak Badan Penyelenggara Jaminan Sosial Kesehatan dalam penanggulangan pembiyaan program Jaminan Kesehatan Nasional?. Dari hasil penelitian didapatkan bahwa dalam hal hubungan perjanjian kerjasama antara pihak BPJS Kesehatan dengan RSMH Palembang berlaku untuk 1(satu) tahun dan selanjutnya dapat diperpanjang. Hubungan hukum tersebut berkaitan antara beberapa pihak yakni pihak BPJS dan RS selaku penyelenggara jaminan sosial dan pasien/peserta BPJS selaku pemakai jasa dalam layanan kesehatan BPJS. Dalam hal kendala yang dikeluhkan dari peserta program Jaminan Kesehatan Nasional yang seperti sulit untuk mendapatkan kamar rawat inap, dikarenakan RSMH merupakan RS rujukan nasional di Provinsi Sumatera Selatan dan sekitarnya. Dalam hal pelayanan kesehatan pihak RSMH Palembang telah memberikan prasarana fasilitas yang sangat memadai dan terlengkap. Untuk sarana dan prasarana sendiri terdiri dari dua fasilitas yakni fasilitas rawat inap dan fasilitas di bagian obat-obatan untuk peserta BPJS Kesehatan. Dan yang terakhir Untuk pembayaran manfaat masuk ke dalam dana DJS yang bersumber pendanaan dalam penyelenggara JKN berasal dari iuran perserta PBI dan bukan PBI (PMK Nomor 28 Tahun 2014). Kontribusi pemerintah yaitu presentase realisasi penerimaan pajak rokok bagian hak masing-masing daerah provinsi/kabupaten/kota (Perpres Nomor 82 Tahun 2018). Kata Kunci : Perjanjian, Badan Penyelenggara Jaminan Kesehatan (BPJS) Kesehatan, RSMH, Pelayanan Kesehatan . ABSTRACT It is affirmed in Article 28 paragraph (3) and Article 34 paragraph (2) of the 1945 Constitution "Social security is the right of every citizen" and "The state develops a Social Security System for all the people and weak empowers and underprivileged people". For this reason, the government organized social security programs, especially for the purpose of ensuring the health rights of the poor or less fortunate. Therefore, the writer conducted a study entitled "Cooperation Agreement between the Healthcare and Social Security Agency and Dr. Mohammad Hoesin General Hospital in the Implementation of Health Services." This normative research examined; 1. How was the relationship between the Healthcare and Social Security Agency and Dr. Mohammad Hoesin General Hospital ?, 2. How was the implementation of health service insurance by Dr. Mohammad Hoesin General Hospital for participants of the national health insurance program ?, 3. What were the efforts of the Healthcare and Social Security Agency in overcoming the financing of the National Health Insurance program? From the research results, it was found that in terms of the relationship between the the Healthcare and Social Security Agency and Dr. Mohammad Hoesin General Hospital Palembang, the cooperation agreement was valid for 1 (one) year and could then be extended. The legal relationship was related between several parties, namely the the Healthcare and Social Security Agency and Dr. Mohammad Hoesin General Hospital as the provider of social security and Social Security Agency patients / participants as service users in Healthcare and Social Security Agency health services. In terms of the obstacles that the participants of the National Health Insurance program complained about, it was difficult to get inpatient rooms, because Dr. Mohammad Hoesin General Hospital is a national referral hospital in South Sumatra Province and its surroundings. In terms of health services, Dr. Mohammad Hoesin General Hospital Palembang had provided a very adequate and complete facility infrastructure. The facilities and infrastructure consisted of two facilities, namely inpatient facilities and facilities in the medicine section for Healthcare and Social Security Agency participants. And lastly, for the payment of benefits, it went into the social security fund, the source of which was the funding for National health insurance administrators, which came from contributions from contribution assistance and non-contribution assistance participants (PMK Number 28 of 2014). Government contribution was the percentage of realization of cigarette tax revenue as part of the rights of each province / district / city (Presidential Decree Number 82 of 2018).
