Abstract

Penelitian ini bertujuan untuk mengetahui penerapan pasal 136 Undang-Undang Nomor 18 Tahun 2012 tentang Pangan dalam putusan No.1790/Pid. Sus/2016/PN.Plg dan No. 398/Pid.Sus/2017/PN.Plg serta pertimbangan yuridis dan non yuridis yang dipergunakan hakim dalam mengadili perkara. Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif. Metode normatif bersumber dari data-data kepustakaan serta peraturan perundang-undangan terkait. Dari hasil penelitian, maka dapat disimpulkan bahwa penerapan sanksi pidana sama terhadap produsen pangan berformalin dalam putusan hakim yang berbeda yakni 2 (dua) bulan penjara meski tingkat kesalahan pelaku dan keadaan yang melingkupinya berbeda. Maka dapat disimpulkan bahwa tujuan pemidanaan yang ingin dicapai oleh hakim bukan hanya tujuan distributif atau membalas, tetapi juga untuk memperbaiki pelaku tindak pidana dan mewujudkan ketertiban dalam masyarakat.
