Abstract

Disparitas penjatuhan putusan pidana dalam tindak pidana memberikan keterangan palsu. Adapun rumusan masalah yang dibahas adalah mengapa terjadi disparitas penjatuhan putusan pidana dalam tindak pidana memberikan keterangan palsu serta bagaimanakah pertimbangan hakim terhadap penjatuhan putusan pidana dalam tindak pidana memberikan keterangan palsu. Menggunakan teori pembuktian dan teori penjatuhan putusan. Metode penelitian yang digunakan dalam skripsi ini adalah normatif. Bahan hukum yang diteliti adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian ini menyimpulkan bahwa terjadinya disparitas dalam penjatuhan putusan pidana disebabkan oleh pertimbangan majelis hakim dalam menjatuhkan putusan pidana kepada pelaku tindak pidana memberikan keterangan palsu dengan sanksi pidana yang berdasarkan Pasal 242 KUHPidana Indonesia.
