Abstract

District heads Election and deputies was one of the parts of democracy and a kind of locomotive to implement the reformation mandate in which people come to vote their district heads. However, the election of district heads is rife about cheating practices from money politics to disputes of election result. So far the focus of the election violation is on criminal sanctions even though the general election is inseparable from administrative law and the extent to which the role of the implementing agency, especially election supervisors to follow up on the violation of the general election of the district head and deputy regional head. Based on the explanations above , the acts of violating the administration of the General Election need to be described to explain what the act of violating the administration of the General Election, the legal issues discussed in this study are1) how can we identify administrative breaches at the stage of the zoning campaign for the distric head and deputies? , 2) how did the provincial Election Supervisory Agency (BAWASLU) play role in solving administration breach at the campaign stage for the election of district heads regional heads?, 3) how might a disciplinary action be applied to the administrative breach at the stage of the campaign for regional elections and deputies? This study was a normative research, and data sources were from primary and secondary data, gathered through literature and field studies which were quantitatively analyzed, with deductive deduction drawing techniques. There were three conclusions drawn in this study. First, how to identify administrative violations at the campaign stage Election of Districts Heads Regional Heads can be known from the scope that administrative violations include elements of procedures, procedures, and administrative mechanisms that are limited to campaign matters beyond violations of ethical codes, criminal, and disputes, which is reported to the Provincial Election Supervisory Agency (BAWASLU). Findings from the results of its supervision are then recommended and followed up by the Provincial General Election Commission (KPU) with administrative sanctions imposed. Secondly, the roles of the Provincial Election Supervisory Agency (BAWASLU) in resolving administrative violations at the campaign stage of the Election of Districts Heads Regional Heads were to make recommendations on the results of studies / findings of alleged administrative violations, then they are recommended to the Provincial General Election Commission (KPU) to be followed up. Third, the applications of sanctions to perpetrators of administrative violations at the election stage of the Governor and Governor Prov. South Sumatra in 2018 procedurally were : the findings or reports of violations were submitted to the Provincial Election Supervisory Agency (BAWASLU) and if they are proven true; reports were recommended or forwarded to the Provincial General Election Commission (KPU) . The General Election Commission (KPU) followed up with administrative sanctions in the form of written warnings or warnings against perpetrators.
