Abstract

Perlindungan serta rasa aman merupakan suatu bentuk hak dan sudah semestinya dimiliki dan dirasakan oleh setiap anak tanpa terkecuali. Namun hingga saat ini, masih banyak kejahatan-kejahatan yang menjadikan anak sebagai objek kejahatan, salah satunya tindak kejahatan eksploitasi seksual. Tindak pidana eksploitasi seksual terhadap anak yang memiliki bentuk beragam seperti pelacuran anak, pencabulan anak, perdagangan anak untuk tujuan seksual, pornografi anak dan masih banyak bentuk lainnya sangat rentan dialami oleh anak. Dalam penulisan kali ini penulis melihat bentuk perlindungan terhadap korban anak eksploitasi seksual yang diakomodir oleh hukum pidana Indonesia, baik yang ada di dalam Kitab Undang-Undang Hukum Pidana (KUHP) maupun peraturan perundang-undangan diluar KUHP. Penelitian ini ditujukan untuk mengkaji bagaimana penerapan perlindungan hukum terhadap anak korban eksploitasi seksual melalui analisis putusan hakim dari kasus-kasus eksploitasi seksual anak yang telah ada sebelumnya. Metode yang digunakan dalam penelitian ini adalah normatif. Hasil penelitian ini menyimpulkan bahwa bentuk perlindungan terhadap anak dari tindak pidana eksploitasi seksual, yaitu salah satunya dengan memidana pelaku kejahatan eksploitasi seksual terhadap anak dengan hukuman yang lebih berat jika dibandingkan dengan korban orang dewasa dengan jenis tindak kejahatan yang sama
