Abstract

Skripsi ini berjudul “Analisis Yuridis Penerapan Sanksi Pidana Terhadap Pelaku Pemotongan Alat Kelamin yang Dilakukan oleh Isteri Terhadap Suami (Studi Kasus Putusan Nomor: 540/Pid.Sus/2018/PN.Llg)”. Adapun rumusan masalah yang akan dibahas adalah pertimbangan hukum hakim dalam menjatuhkan sanksi pidana dan bagaimana penerapan sanksi pidana terhadap pelaku pemotongan alat kelamin yang dilakukan oleh isteri terhadap suami. Penulisan skripsi ini menggunakan metode penelitian yuridis normatif dan empiris. Dari hasil penelitian diketahui bahwa hakim dalam menjatuhkan putusan harus berdasarkan Undang-undang Nomor 23 tahun 2004 pasal 44 ayat (2) tentang penghapusan kekerasaan dalam rumah tangga (PKDRT) dan aspek yuridis, dan aspek non-yuridis, agar tidak terjadinya putusan yang tidak adil atau merugikan terdakwa. Pelaku tindak pidana pemotongan alat kelamin yang dengan sengaja dilakukan oleh isteri terhadap suami dapat dijatuhkan sanksi pidana apabila sudah terpenuhinya delik tindak pidana penganiayaan dan Dari analisis penulis dapat diketahui bahwa putusan diatas telah memenuhi syarat subjektif dan objektif serta tujuan Pemidanaan.
