Abstract

This study aims to analyze the obstacles faced by the State Attorney (JPN) in recovering state financial losses in corruption cases, and criminal law policies in the future. The results of this study indicates that the obstacles to legal action by JPN to recover state financial losses are found from several factors. From legal factor, laws and regulations do not provide a solution or other alternative if the defendant does not have cash or assets to recover state financial losses so that civil decisions are only executed by repeated collection either out of court or after a court decision. From law enforcement factor, it is closely related to infrastructure, culture, and community factor, that the JPN is constrained by the absence of technology to track and trace the assets/assets of the defendant. In addition, the defendant's lack of legal awareness to be honest and reporting personal assets resulted from criminal acts of corruption and tends to cover up. Finally, the implementation of confiscation of the defendant's assets as an effort to recover state losses with a long period of time from the lawsuit to the confiscation and auction of assets became a legal loophole for the defendant to embezzle and transfer the assets. The criminal law policy against JPN legal actions to recover state financial losses in the court of corruption in the future is the government's action in formulating policies related to alternative execution of restitution of state financial losses through payment and confiscation of collateral (auction) if the defendant is unable to pay or no longer owns asset. In addition, in order to avoid the defendant's action of hiding or embezzling the assets resulted from the criminal act of corruption and for the convenience of tracking the defendants' assets originating from corruption, data collection and confiscation of assets while the defendant is a suspect must be carried out since the investigation stage.
