Abstract

Implementation of Diversion and PERMA No. 4 of 2014 concerning Guidelines for the Implementation of Diversion in Decision No.53 / Pid.Sus-Anak / 2019 / PN / Plg and No.73 / Pid.Sus-Anak / 2019 / PN / Plg implies that there is inconsistency of law enforcement officials in the settlement child narcotics case. Thesis aims to find and obtain arrangements for the implementation of the Diversion of children in conflict with the law in the future against narcotics crime. The type of this research is descriptive analysis, using a normative approach. Primary data were obtained from interviews with respondents in the field and secondary data were obtained from the literature. The technique of collecting primary legal materials was carried out by purposive sampling and secondary legal materials by means of literature studies. Legal material management techniques are carried out by comparing concepts with theories. Legal material analysis techniques use descriptive qualitative analysis and then the data is amplified to generate a conclusion that will answer the questions of the problem. This thesis concludes the implementation of Diversion and PERMA No. 4 of 2014 concerning Guidelines for the Implementation of Diversion related to special crimes for children in narcotics crimes is still not in accordance with the principles of restorative justice. The results of this study recommend that the implementation of Diversion and PERMA No. 4 of 2014 concerning Guidelines for the Implementation of Diversion of Judges are obliged to consider the criminological aspects of children, then in terms of implementing regulations at each level it must be in line with the objectives and principles of Law Number 11 of 2012 concerning SPPA so as to provide legal certainty.
