Abstract

Judul Skripsi “Perjanjian Bantuan Hukum Timbal Balik (Mutual Legal Assistance) dalam Pengembalian Aset Kasus Korupsi” dalam penelitian ini penulis menemukan permasalahan berupa : 1. Bagaimana pengaturan tentang bantuan hukum timbale balik dalam masalah pidana di Indonesia? 2. Bagaimana penanganan dalam pengembalian aset kasus korupsi yang berada diluar negeri melalui sistem MLA?. Metode penelitian yang dilakukan dalam penulisan skripsi ini dilakukan secara normatif dengan pendekatan Undang-Undang dan pendekatan kasus, serta menggunakan bahan primer, sekunder, dan tersier. Dari hasil penelitian ini dapat kita simpulkan bahwa Indonesia telah mengatur mengenai MLA pada Undang-Undang No.1 Tahun 2006. Dalam melakukan pengembalian aset hasil korupsi yang ada diluar negeri pemerintah ndonesia pernah berhasil melakukannya melalui mekanisme MLA, akan tetapi keberhasilan ini kurang signifikan dibandingkan kerugian yang dialami Negara. Kata Kunci : Mutual Legal Assistance, Asset Recovery, Korupsi.
