Abstract

The Exploitation of old oil wells has strategic and economic potential. Regulation of The Minister of Energy and Mineral Resources No.1 of 2008 was issued to optimize the production of petroleum in a working area in which old wells are located and to promote the welfare of the surrounding community by engaging them in participation. PT Pertamina EP as a state-owned company cooperates with PT Petro Muba as a local-government-owned company in petroleum production at 565 old wells in Babat and Kukui Fields of Sungai Angit Village. This study aims at several objectives: (1) analyzing and evaluating the implementation of the Minister of Energy and Mineral Resources Regulation No.1 Year of 2008 in the cooperative exploitation of old oil wells between PT Pertamina EP and PT Petro Muba in Babat and Kukui Fields of Sungai Angit Village; (2) identifying and evaluating legal barriers to the regulation implementation; and (3) analyzing and evaluating the legal implications of cooperative exploitation for the companies, local development and community welfare in the concession area. Based on the results of this normative juridical study, it is concluded that: (1) the cooperation in the agreement between PT. Pertamina EP and PT Petro Muba has adhered to the regulation with production service fee model agreement and five years period extendable to another five years; (2) in its implementation, it is necessary to minimize obstacle in the aspects of facilities and community culture, and it is also important to increase traditional miner’s commitment; and (3) law enforcement officials have made preventive efforts to legally protect and provide benefits to the community’s economy and development in the concession area
