Abstract

Pandemi covid-19 membawa dampak yang besar dalam segala aspek kehidupan. Salah satunya dalam proses persidangan tindak pidana korupsi, yang saat ini menggunakan persidangan secara teleconference. Pada penelitian ini akan membahas mengenai Implementasi asas peradilan yang cepat, sederhana, dan biaya ringan dalam pelaksanaan persidangan tindak pidana korupsi melalui teleconference pada masa pandemi covid-19. Penelitian ini merupakan penelitian hukum normative, dengan menggunakan pendekatan perundang-undangan, serta pendekatan kasus. Adapaun hasil penelitian ini menunjukan bahwa, berdasarkan penyelenggaraan MA (Mahkamah Agung) membentuk PERMA No. 4 Tahun 2020 tentang administrasi dan persidangan perkara pidana di pengadilan secara elektronik. Perma ini disusun oleh Pokja berdasarkan SK KMA No. 108/KMA/IV/2020 tentang kelompok kerja administrasi dan persidangan perkara pidana di pengadilan secara teleconference. Perma persidangan teleconference ini sebagai tindak lanjut nota kesepahaman antara MA, Kejaksaan Agung, Kepolisian, Ditjen Permasyarakatan Kementrian Hukum dan HAM tentang pelaksanaan persidangan melalui teleconference dalam rangka pencegahan covid-19. Pada prinsipnya hakim/majelis hakim, panitera pengganti bersidang di ruang sidang pengadilan, sedangkan penuntut umum mengikuti sidang dari kantor penuntut umum, terdakwa didampingi atau tanpa didampingi penasihat hukumnya mengikuti sidang di Rutan tempat terdakwa ditahan. Hambatan persidangan tindak pidana korupsi melalui teleconfernce terdiri dari faktor internal dan faktor ekternal. Untuk masa yang akan datang Pengaturan terhadap persidangan tindak pidana korupsi melalui teleconference oleh karena itu perlu ada perubahan di dalam KUHAP (Kitab Undang-Undang Hukum Acara Pidana) sehingga mengatur secara tertulis peraturan persidangan secara teleconference tersebut. Kata Kunci : Asas Cepat, Sederhana dan Biaya Ringan, Persidangan Tindak Pidana Korupsi, Teleconference, Pandemic Covid-19. The Covid-19 pandemic has a major impact in all aspects of life. One of them is in the trial process for criminal acts of corruption, which currently uses the trial by teleconference. This research will discuss about the implementation of judicial principles that are fast, simple, and low cost in carrying out trials of corruption crimes via teleconferences during the Covid-19 pandemic. This research is a normative legal research, using a statutory approach, as well as a case approach. As for the results of this study indicate that, based on the implementation of the Supreme Court (Supreme Court) formed PERMA No. 4 of 2020 concerning the administration and trial of criminal cases in court electronically. This Perma was prepared by the Working Group based on SK KMA No. 108 / KMA / IV / 2020 concerning the administrative working group and trial of criminal cases in court by teleconference. This teleconference trial is a follow-up to the memorandum of understanding between the Supreme Court, the Attorney General's Office, the Police, the Directorate General of Corrections, the Ministry of Law and Human Rights regarding the implementation of the trial via teleconference in the context of preventing Covid-19. In principle, the judge / panel of judges, the substitute clerk of the court hears in the courtroom, while the public prosecutor attends the trial from the public prosecutor's office, the defendant is accompanied or without his legal adviser to attend the trial at the detention center where the defendant is detained. The obstacles in the trial of corruption by means of teleconference consist of internal factors and external factors. For the future, the regulation of corruption trial through teleconference is therefore necessary to make changes in the Criminal Procedure Code (KUHAP) so that it regulates in writing the trial regulations by means of the teleconference.
