Abstract

Skripsi ini bertujuan mengetahui proses KPPU menafsirkan perjanjian tertutup dan penguasaan pasar yang dilakukan oleh PT Tirta Investama dan PT Balina Agung Perkasa, dan mengetahui kepastian hukum dalam menggunakan metode penafsiran untuk penyelesaian perkara perjanjian tertutup dan penguasaan pasar oleh KPPU. Penelitian ini menggunakan metode penelitian yuridis normatif dengan menggunakan metode perundang-undangan (Undang-Undang Nomor 5 Tahun 1999) dan pendekatan kasus yang mengacu pada Putusan KPPU Nomor 22/KPPU-I/2016 yang bertujuan untuk menelaah suatu kasus yang telah diputuskan di pengadilan dengan berkekuatan hukum tetap. Hasil analisis mengungkapkan bahwa KPPU menafsirkan perjanjian tertutup dan penguasaan pasar tersebut menggunakan metode penafsiran dengan teori pendekatan rule of reason, hingga diputuskanlah perkara Nomor 22/KPPU-I/2016 telah memenuhi unsur pelanggaran Pasal 15 Ayat (3) dan Pasal 19 huruf a dan b Undang-Undang Nomor 5 Tahun 1999. Selain itu, kepastian hukum menggunakan metode penafsiran dengan teori pendekatan rule of reason adalah tepat dan dikuatkan dengan Pasal 35 huruf a Undang-Undang Nomor 5 Tahun 1999.
