Abstract

This thesis is titled Criminal Arrangement Against Pimps who Market Prostitution Online. Case Study of Denpasar District Court Decision Number 642 / Pid.B / 2015 / PN.Dps. The focus of this research is about prostitution according to criminal law and about responsibilities to those involved in prostitution. In this paper takes the issue of how to regulate criminal sanctions against pimps who market prostitution through online facilities based on positive Indonesian criminal law, and how legal considerations impose criminal sanctions against pimps in a district court ruling number: 642 / Pid.B / 2015 / PN.Dps . In the analysis it was found that the perpetrators of pimps were convicted by Article 296 of the Criminal Code and if marketing prostitution through online facilities is aggravated by Article 27ayat (1) of Law no. 11 of 2008 concerning Information and Electronic Transactions. The research method used in this thesis is a research method carried out with a normative juridical approach that is by analyzing the problem through the principles of the law as well as referring to legal norms contained in legislation. The results of this study as an answer to the above problems are, first, criminal arrangements against pimps who market prostitution online are regulated in positive Indonesian law, namely article 296 of the Criminal Code and article 27 paragraph (1) of Law no. 11 of 2008 concerning Information and Electronic Transactions. Both judges in imposing criminal sanctions in case Number 642 / Pid.B / 2015 / PN.DPs saw based on the available evidence and added to the judge's own conviction.
