Abstract

Skripsi ini berjudul "Analisis Yuridis Dan Teoritis Rak Pilih Penderita Gangguan Jhva Berdasarkan Putusan Mablwnah Koasfitosi Nomor 135/PUU/XUI-2015." Pennasalahan yang dibahas dalam skripsi ini adalah: Dasar Pertimbangan Putusan Mahkamah Konstitusi Nomor 135/PUU/XIII-2015 Yang Memutus Penderita Gangguan Jiwa/Ingatan Dapat Menggundakan Hak Pilihnya. Dan Selanjutnya, Bagaimana Kajian teoritis Tentang Cakap Bagi Warga Negara Dalam Melakukan Perbuatan Hukum. Jenis penelitian ini adalah bahan hukun primer, sekunder, tersier yang disimpulkan dengan studi pustaka dan berbagai literature dengan mengkaji peraturan perundang-widangan yang terkait dengan permasalahan. hasil penelitian ini menyimpulkan, bahwa pasa1 57 ayat 3 huruf (a) UU No. 8 tahun 2015 yang menjadi sengketa hukum di Mahkamah Konstitusi, bertentangan dengan UUD 1945 Pasal 28D. Selanjutnya, terdapat kriteria dan kualifikasi tertentu terkait orang dengan gangguan jiwa/ingatan.
