Abstract

Restorative Justice is one approach that can be taken in handling cases of child crime carried out by diversion diversion. Diversion is a transfer of the settlement of a child case from a criminal justice process to a process outside of criminal justice, in the Child Criminal Justice System Law emphasizes that the diversion process must be applied in various stages, one of which is at the prosecution stage carried out by the Child Prosecutor. From this background the problem arises as to how the role of the public prosecutor in the resolution of the case of diversion of children in conflict with the law in the Palembang District Attorney and What are the obstacles for the public prosecutor in the Palembang District Attorney in implementing the diversion of children in conflict with the law. This type of research is empirical juridical research. The method used is the legal approach and the sociology of law approach. The data sources used are primary data from interviews and secondary data from the literature. Based on the results of research conducted that the role of public prosecutors in resolving diversion cases is as a facilitator. Factors that hampered the application of the diversion process at the Palembang District Attorney's Office were the lack of law enforcement, lack of facilities and infrastructure and community factors.
