Abstract

Trade agreement, whether directly or not is related to the national development in Indonesia. National development is the effort of development continuity which covers all aspect of social life, nation and State to manifest the national objection as it is stated in the preamble of the 1945 constitution; protect all the people of Indonesia and their entire indigenous land, in order to improve the public welfare, to advance the intellectual life of the people and to contribute to the establishment of a world order based on freedom, eternal peace and social justice so it’s necessary to notary as public servant to give a protection to the client by not make an error in his document. Problem in this skripsi are if a what is the liability of if they don’t careful in making notary document. notary his duty to record any economic acts into a lawfully prepared, and how is the notary liability if they make any procedural error in record a economic acts into a lawfully prepared or in making notary document. To collect the data to process have been done, the method of this using descriptive approach to get an normative data which are tertiary, secondary, and primary law material a society with the problem following by explanative approve whit is primary data from respondent which are notaries public; discipline commission of notary using purposive sampling to resolve the problems of this research. A notary is one of the notaries public who notarize documents which have law effect in buying and selling, rental agreement, and other agreement in social life. Basically, the duty of a notary is to record any economic acts into a lawfully prepared Considering the importance of the duties and responsibilities of a notary in this modem life, it is not impossible whether it is intentionally or not a notary can perform unprofessionally act. The conclusion at last recommended for notary public to resolve the problem by careful in making notary’s documents which have law effect in buying and selling rental agreement, and other agreement in social life. In this case, it is supposed that notary organization will be strict in upholding the notary profession ethics. The discipline commission of a notary organization that usually consists of some colleagues of the notary profession itself, changed to consist of academician : the discipline hearing that usually conducts a close to public turns into an open one, that reflects professionals characters.
