Abstract

a notary public public sometimes faces obstacles in carrying out his/her duties and positions. A Notary public has the right to get a leave and to fill vancancies as a result of a Notary being on leave. In a case a Notary public being on leave, the Notary must appoint a substitute Notary. The problem discussed in this study concern the civil and the criminal responsibilites of a substitute Notary in practice after the end of his/her position as as substitute Notary and the legal arrangements that should be used in the fulfillment of the civil and the criminal responsibilities of substitute Notary after the end of the term of office. The objective of this study is to analyze the civil and the criminal responsibilities of a substitute Notary in practice after the end of his/her position as a substitute Notary and to analyze the legal arrangements that should be used in relation to the fulfillment of the civil and the criminal responsibilities of a substitute Notary after the end of the term of office. This is a normative study using a statutory approach, scientific works, books, journals related to the topic of writing. This study uses the primary, the secondary, and the tertiary legal materials. The results of this study state that the substitute Notary is obliged to carry out his/her duties by emphasizing the principles of accuracy and prudence. When there is legal issue or a dispute that causes harm to another person, the substitute Notary can be prosecuted for the fulfillment of both the civil and the criminal responsibilities. The conclusion of this study confirms that the responsibility of the substitute Notary is binding on the deeds he/se mde while carrying out his substitute position. The current regulation regarding substitute Notary is considered less relevant because starting from the implementation of the appointment, the requirements given to become a substitute Notary are considered too easy and not in line with the responsibilities that will be carried out later. So that a separate arrangement is needed that is more accomodating regarding the substitute Notary, especially regarding the future legal protection after the end of the term of office.
