Abstract

A marriage is an inner and outer ties between a man and a women to gather a happy family. Purpose of the marriage is for continue the lineage and it’s one of the sunna messenger that must be done. And legally, it regulated in the legislation number 1 of1974 a marriage that performed in accordance with statutory regulation is official marriage and if it violated there would be a problem in it. One of them, when this problem put into the police institution, as well as we know that police institution is an institution containing law enforcement agencies that have a strict discipline. If it violated, there will be a sanction. In this thesis, there is sampel case from one of the police member, Bripda Nu that done a violating marital And the problem is this thesis is how the law enforcement for the police member violating the marital in Ogan Komering Ilir (OKI) and how the sanction that given by the police institution for it ’s member that done the violating marital Based on result research, the conclusion is Bripda Nu has done a violating marital, he has siri married with Ma and having legal wife, Ft. In this case Bripda Nu don 7 get the criminal sanctions as well as the accusation from Ma that accused commited the crime origins of marriage in section number 279 KUHP juncto 280 KUHP because from the investigation result is issuing a warrant dismissal of the investigation (SP3). Next from the police institution Bripda Nu is given a disciplin punishment because he violated the disciplinary regulations of Polri member arranged to govemment regulation number 2 of 2003, this punishment applicated through the disciplinary hearing that give a final decision based on section number government regulation number 2 of2003, and result of disciplinary hearing stated Bripda Nu sentenced two periods of delay promotions and placed in a special places for 21 days.
