Abstract

Along with reformasi, corruption becomes one of the important agenda that must be completed by the Indonesian nation. Corruption crime Gratuity as part of corruption is a crime that is hiding and is very difficult to prove. Difficulty proving the crime of Corruption is an obstacle in the process of Gratuity disclosure Gratification Corruption crime. Mechanism of reversal of the burden of proof, or better known as reverse proof system is a mechanism that is considered is a solution to reveal the crime of Corruption of Gratification. Inverted proof system is defined as a mechanism of proof which the guilty party who has the obligation to prove his innocence. Verification mechanism is not upside down is something really new in the Indonesian criminal justice system. Policy legislation goveming corruption and Gratuity, this mechanism stipulated in the Law No.20 year 2001 conceming the Amendment of Act No.31 of 1999 on Eradication of Corruption although since the Act No. 5 of 1960 and Act No. 3 of 1971 has been mentioned on the systems of proof reversed. Basically, in each examination on trial for corruption and corruption case the defendant is given the right Gratuities (opportunity) to prove that he had not committed the crime of corruption. Verification system upside down is an obligation for the defendant accepting gratuities 10 million rupiah or more, and to prove the property has not been charged is not the result of corruption
