Abstract

Cara pandang negara-negara anggota ASEAN terhadap demokrasi dan H AM mengalami perubahan sejak keikutsertaan ASEAN di World Conference on Human Rights di Wina, Austria tahun 1993 yang menghasilkan Vienna Declaration and Programme of Action (VDPA). ASEAN sebagai organisasi regional diharuskan mempromosikan dan menghormati hlAM dengan berpedoman kepada HA M internasional. ASEAN Charter merupakan landasan dibentuknya ASEAN Human Rights Body (AHRB) yang merupakan wujud kepedulian ASEAN terhadap perlindungan dan penghormatan HA M. Walau ada anggapan bahwa ASEAN masih belum serius dalam nmenyelesaiakan masalah pelanggaran HA M, oleh karena prinsip non- interference masih diterapkan dalam penyelesaian masalah pelanggaran HAM. Akibatnya Term of Reference (TOR) AHRB sampai dengan saat ini belum menetapkan instrument hukum sebagai konstitusi dasarnya. European Commission of Human Rights yang ada di Eropa merupakan rujukan yang ideal bagi terbentuknya mekanisme HAM ASEAN.
