Abstract
Business competition is one of the essential factors in thejree trade system in Indonesia. Distortion of trade can be caused by monopolistic practices and unfair business competition which tends to be done by strong companies. Therefore, Indonesia as a facilitator and protector of business world should pursue the creation of rules -which the implementation could guarantee a healthy competition, To anticipate the monopolistic practices and unfair business competition, Indonesia as a member of the World Trade Organization (WTO) have agreed to certain agreements relating to the regulation of monopoly activities and unfair business competition related with areas of Market Access, Subsidies, Anti-Dumping and Safeguard. The approval and legalization of these agreements create a new history of world trade development which generated both rights and obligations which are directly tied to its members after they declared themselves to be bound and subject to under a convention or other international law. One of the special rights held by Indonesia as a developing country in its membership in the WTO is getting special treatment (special and differential (S & D) treatment). Practically, free trade in Indonesia use anti-dumping rules and antitrust in accordance with the provisions of the WTO to create healthy competition and avoid monopolies and other unfair business competition which could destroy the business or businessmen in the country. The use of anti-dumping rules and anti-monopolies in Indonesia implemented in legislation. To handle such rights, Indonesia has Act No. 5 Year 1999 regarding Prohibition of Monopolies and Unfair Business Competition. One of the reasons of its birth is Indonesia has signed the Maracas Agreement on the establishment of the WTO which has been ratified by Act No. 7 Year 1994.
