Abstract

The rate of populalion growth in Indonesia is higher from year to year is an impact on employment issues, unemployment, poverty and migration. Based on employment statistic, the crussial that faced by Indonesian Labour market today is unemployment problem. Job vacancy in this country appertaining less to ojfset the amount of labor force increased. This condition triggers the Indonesian to migrate out to other country to be Indonesian Workers. Indonesian worker become an alternative solution to overcome high unemployment and also to increase the welfare of workers and their families. Realizing, many Indonesian workers work abroad especially in Malaysia, and poor protection of overseas workers which caused many violence cases against the Indonesian Workers even death, so it is necessary to create a bilateral cooperation between Indonesia and Malaysia so that the government can guarantee the safety and fulfillment the rights of Indonesian workers in Malaysia. This writing method is a normative research which analysis method using secondary data sources in the form of legislations, court decisions, legal theory, and scholars opinion (doctrine). This research is expected provide inputs for improvemenls in providing protection for Indonesian workers. The Government focus the protection of Indonesian workers since their departure to placement process.
