Abstract

ABSTRACT The Responsibility of The Land Deed Official That Made Without Certificate Inspection at The National Land Agency of Palembang City By : Haris Ammar, Achmad Romsan, Abdullah Hamid The legal responsibility of the Land Deed Official (PPAT) for the deed of sale and purchase made before him must be verified by National Land Agency of Palembang City which aims to provide, eliminate, or at least reduce the possibility of conflicts or disputes related to land, so that it can provide guarantees and protection to landowners, to carry out the protection and legal certainty, it is carried out by Land Deed Official that appointed by the Minister of Agrarian Affairs and Spatial Planning in the form of making an Authentic Deed based on the Regulation of Land Deed Official Position, The purpose of this study were to analyze the legal responsibilities of Land Deed Official for the deeds of sales and purchase that made before him without a certificate inspection and to analyze the legal consequences of the deed of sale and purchase that made by the Land Deed Official at the office of Land Agency of Palembang City. This study used normative research as library research or document study because this study is carried out or aimed only for written regulations or other legal materials. The approach used in this research is the legal, conceptual, legal sociology, and legal history approach. The results of this study conclude that the regulation of the Land Deed Official, in the Laws and Regulations related to Land Deed Officials, it was regulated when a Land Deed Official was proven to have violated the deed he made without being examined while carried out its duty and position, could be given administrative sanctions, but it was not regulate the civil or criminal sanctions for Land Deed Official, so that if there were violations that meet civil and/or criminal offenses against the Land Deed Official, could be given civil sanctions based on Criminal Code and/or criminal sanctions based on Criminal Code.
