Abstract

Notaries in the service sector are officials authorized by the state to serve the public in the civil sector, especially in making authentic deeds. Nowadays people still find it difficult to understand the importance of an authentic deed in an agreement, in which the deed provides legal protection and legal certainty for the parties. Several problems are like the role of notary to provide legal protection to housing loan borrOwers, the obstacles and solutions in implementing standard housing loan agreements. This study was aimed at identifying and analyzing the roles of notaries. This study used empirical legal method, and several resource persons were needed to support this research. The results of the study showed that there were several important roles that must be carried out by a notary when signing a deed, like providing legal counseling on the content of the deed to be signed. Inadequate legal regulations to make transactions were the main obstacle in the discussion of this study Structurally in terms of supervision it was quite good but less optimal because of many disputes over agreements made by notaries. There was still the risk of problems arising from the agreements made by notaries, especially those made under hand. The notarial deeds should guarantee the rights of the clients by providing protection. In addition, the regulations that require every transaction to use an authentic deed made by a notary must be more emphasized.
