Abstract

Crowdfunding is and information technology-based financing intended for SME’s owned by the issuers to develop their business with capital assistance from the public as investors and facilitated by an organizer as an intermediary. The problems in this thesis are as follows: how to arrange securities offerings, appropriateness of arrangements for securities offerings, and how to arrange securities offerings through information technology-based crowdfunding services based on sharia principles. This is a normative legal research aiming at analyzing the suitability of crowdfunding arrangements from the perspective of sharia principles and the conclusions are drawn deductively. Crowdfunding is regulated in Law Number 8 of 1995 and POJK Number 57/POJK.04/2020. Basically It is in accordance with sharia principles because it is in accordance with the recommended contract and does not conflict with things prohibited in sharia principles. So there is only a need for confirmation by an authorized institution such as the OJK by doing the development related to crowdfunding regulations and issuing a decree containing a list of sharia organizers and MUI fatwas related to crowdfunding based on sharia principles so that the regulation has a clear legal standing.
