Abstract

This study aims to determine and analyze violations of the contents of the patent license agreement committed by licensees. In addition, to analyze the role of the notary in making a license agreement. This research is a normative legal research. The approach used in this research is a statutory approach as well as a conceptual approach. The results of this study indicate that the law has regulated the license agreement but has not clearly stipulated the rights and obligations of the parties in the license agreement, as well as knowing what legal consequences arise if there is a violation of the clause granting a license to third parties committed by licensee in the field of patents. Furthermore, the role of the notary in the license agreement is related to legal counseling to the parties, namely licensors and licensees, regarding the importance of authentic deeds in the agreement for legal certainty and as perfect evidence.
